Ruling upheld

Friday, June 22nd, 2007.

Batesville, AR - When Circuit Judge John Norman Harkey granted a class action lawsuit against a local nursing home, the health care facility appealed.

Wednesday, the Arkansas Supreme Court unanimously upheld Harkey’s decision.

Initially, the lawsuit involved only Helen Cook, a former resident of Batesville Nursing and Rehab.

The lawsuit filed in Independence County Circuit Court accuses the Batesville nursing home of causing Cook’s condition to dramatically worsen in the four months she was there. Annette Thomas, guardian of Cook’s estate, accuses the facility of medical malpractice and ordinary negligence.
