Nursing home liability bill is shunted off to study committee

Nashville, TN – A bill that would rein in lawsuits against nursing homes was sent to a legislative study committee on Tuesday, ending for this session an acrimonious battle over it.
The House Civil Practice Subcommittee voted to create a joint study committee that will review the bill, known as the Nursing Home Patient Protection Act of 2008, and propose a compromise.

Nursing homes had argued that lawsuits are making it too expensive to get insurance and are siphoning money away from resident care.
The state’s association of trial lawyers, as well as advocates for the elderly and disabled, opposed the bill, saying that it cut off one of the only avenues of redress for victims of abuse and neglect.
